1. Acceptance of These Terms

These Terms of Use (“Terms”) govern your use of the mobile game 90°: Tap, Turn, Survive (the “Game”), provided by Fil.Technology (“we,” “us,” or “our”). By downloading, installing, or playing the Game, you agree to these Terms. If you do not agree, please do not use the Game.

2. License

We grant you a personal, limited, non-exclusive, non-transferable, revocable license to download and play the Game on Apple devices you own or control, solely for your personal, non-commercial entertainment, and in accordance with the Apple App Store Licensed Application End User License Agreement (the “Apple EULA”). Where these Terms conflict with the Apple EULA, the Apple EULA governs your use of the Game.

3. Virtual Items and In-App Purchases

The Game includes virtual items such as coins, stars, hearts, box skins, trails, themes, and seasons. Some virtual items can be earned through play, and some can be purchased through optional in-app purchases processed by the Apple App Store.

  • Virtual items and in-game currency have no real-world monetary value and cannot be exchanged for cash or transferred outside the Game.
  • You receive a limited license to use virtual items within the Game; you do not own them. We may modify, manage, or remove virtual items as part of operating and updating the Game.
  • All purchases are final except where a refund is required by applicable law or granted by Apple. Refund requests are handled by Apple under their policies.

4. Acceptable Use

You agree not to:

  • Reverse engineer, decompile, modify, or create derivative works of the Game, except as permitted by law;
  • Cheat, exploit bugs, use unauthorized third-party software, or manipulate scores or leaderboards;
  • Interfere with or disrupt the Game, its servers, or third-party services it relies on;
  • Use the Game for any unlawful purpose or in violation of these Terms or the Apple EULA.

5. Game Center and Leaderboards

The Game uses Apple Game Center for leaderboards. Your use of Game Center is subject to Apple's terms. We may remove scores or restrict access to leaderboards that we reasonably believe were obtained through cheating, exploits, or other violations of these Terms.

6. Intellectual Property

The Game, including its design, artwork, audio, characters, and code, is owned by Fil.Technology and is protected by intellectual property laws. Except for the license granted above, no rights are transferred to you.

7. Updates and Availability

We may update, change, suspend, or discontinue the Game or any of its features at any time, including virtual items and in-app purchase offerings, without liability to you. We do not guarantee that the Game will always be available or error-free.

8. Privacy

Your use of the Game is also governed by our Privacy Policy, which explains how we handle information.

9. Disclaimer of Warranties

The Game is provided “as is” and “as available,” without warranties of any kind, whether express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement, to the maximum extent permitted by law.

10. Limitation of Liability

To the maximum extent permitted by law, Fil.Technology will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of data, profits, or virtual items, arising out of or related to your use of the Game.

11. Children

The Game is suitable for all ages. If you are a minor, please review these Terms with a parent or guardian. In-app purchases should only be made with the permission of the account holder.

12. Changes to These Terms

We may update these Terms from time to time. Changes will be posted on this page with an updated “Last updated” date. Your continued use of the Game after changes take effect constitutes acceptance of the revised Terms.

13. Governing Law

These Terms are governed by the laws of Canada, without regard to its conflict-of-laws principles, except where local consumer-protection laws require otherwise.
